FTC Accuses Former ‘Pharma Bro’ of Violating Lifetime Ban by Trading Drug Stocks
The Federal Trade Commission has filed a complaint alleging that Martin Shkreli, the former pharmaceutical executive known for his controversial pricing practices, has been buying and selling stocks of companies that develop or market medicines, a move that could violate his lifetime ban from the industry.
Shkreli, who earned the nickname “Pharma Bro” after a high‑profile episode involving the price of the antiparasitic drug Daraprim, was barred for life by the FTC several years ago following findings that he engaged in illegal marketing and other misconduct.
The new FTC filing claims that, despite the ban, Shkreli has been active in the stock market, executing transactions in a range of pharmaceutical firms. The commission says the activity was identified through trading records that show repeated purchases and sales of shares linked to drug development and distribution.
Regulators say the ban was intended to prevent Shkreli from influencing the pharmaceutical sector, and any breach undermines the authority of the FTC’s enforcement tools. Violating a lifetime ban could expose him to civil penalties, injunctions and possibly further criminal referrals.
Legal experts note that the FTC can seek monetary sanctions and an order that bars Shkreli from any future involvement in pharmaceutical‑related securities. The agency may also refer the matter to the Department of Justice if it believes criminal conduct is involved.
To date, Shkreli has not issued a public statement regarding the allegations, and his attorneys have indicated that they intend to contest the commission’s claims.
The case highlights the challenges regulators face in monitoring compliance with long‑term prohibitions, especially when individuals turn to financial markets as a way to maintain influence.
Observers will be watching for a court hearing on the FTC’s complaint, which could set precedent for how aggressively lifetime bans are enforced in the biotech and pharmaceutical arenas.
